Injured? What’s Next?

Do I Have a Case?

No one plans to get in an accident, or to have their life completely turned upside down through the negligence or carelessness of another person. Accidents create chaos. What's left in the aftermath is stress and confusion, which is often made more difficult if you've been injured. It's tough to wrap your head around the right questions to ask in order to protect yourself and your loved ones. One of your questions may be, "Do I have a case?"

Elements that determine if you have a case

There are three elements to nearly all cases, which the injured person needs to prove, whether it is a general personal injury case, a car accident, truck accident or motorcycle accident case, a slip and fall case, or a medical malpractice case.

These elements are:

  • Negligence-in broad terms means that somebody did something wrong, acted unreasonably, violated a law or ordinance, or had actions which were below the standard of care.
  • Causation-means that a person's negligence was at least one of the significant causes of the accident or injury.
  • Damages- the amount of money a jury is willing to award for the injury that was caused from someone's negligence. Damages can include general damages such as pain and suffering/loss of enjoyment of life and/or special damages such as medical expenses, costs of vehicle repair, lost wages, decreased earning capacity, or loss of a career.

Most cases settle out of court through negotiation, mediation, arbitration, or some form of alternative dispute resolution.
